§1 Preliminary Provisions

1. The online store available at the internet address www.sklepweyer.pl

is run by the company:

2. These Regulations define the rules of using the Online Store and the rules and procedure for concluding Sales Agreements with the Customer at a distance via the Store.



§2 Definitions

1. Consumer - a natural person concluding an agreement with the Seller as part of the Store, the subject of which is not directly related to its business or professional activity.

2. Seller - Weyer Polska Sp. z o.o. based in Puławy, Al. Tysiąclecia Państwa Polskiego 8/8, postal code 24-110, entered into the National Court Register by the District Court in Lublin, Lublin-Wschód in Lublin with its registered office in Świdnik, 6th Commercial Department of the National Court Register under number KRS 0000344447, with share capital 100,000 PLN, NIP 7162781020, REGON: 060562725

3. Customer - any entity making purchases through the Store.

4. Entrepreneur - a natural person, a legal person and an organizational unit that is not a legal person, the separate law of which grants legal capacity, performs in its own name an economic activity that uses the Store.

5. Shop - an online store run by the Seller at the internet address www.sklepweyer.pl

6. Contract concluded at a distance - an agreement concluded with the Client as part of an organized system of concluding distance contracts (as part of the Store), without simultaneous physical presence of parties, with the exclusive use of one or more means of distance communication up to the conclusion of the contract, inclusive.

7. Regulations - the Regulations of the Store.

8. Order - Customer's declaration of intent submitted by means of the Order Form and aiming directly at the conclusion of the Product Sales Agreement or Products with the Seller.

9. Account - customer account in the Store, it contains data provided by the customer and information about orders placed by him in the store.

10. Registration form - a form available in the Store, enabling the creation of an Account.

11. Order form - an interactive form available in the Store that allows placing an Order, in particular by adding Products to the Basket and defining the terms of the Sales Agreement, including the method of delivery and payment.

12. Shopping Cart - an element of the Store's software in which the Products selected for purchase are shown by the Customer, and it is also possible to determine and modify the given Order, in particular the quantity of products.

13. Product - a movable item available in the Store / a service being the subject of a Sales Agreement between the Customer and the Seller.

14. Sales Agreement - a Product sales contract concluded or concluded between the Customer and the Seller via the Online Store. The Sale Agreement also means - applying to the Product features - a contract for the provision of services and a contract for specific work.

6. The Customer may communicate with the Seller using the addresses and telephone numbers provided in this paragraph.

7. The Customer may communicate by phone with the Seller between: 8.00 am - 4.00 pm



 §4 Creating an Account in the Store

1. To create an Account in the Store, you must complete the Registration Form located on the store's website.

2. Creating an Account in the Store is free.

3. During registration, provide correct and true data, otherwise the order may be unrealized.

4. The personal data of our clients are collected only for the purposes of the Store and processed in order to implement the statutory business activity of the company while maintaining the data protection requirements in accordance with the Act of 29 August 1997 (Journal of Laws 1997 No. 133, item 833) on personal data protection.

5. Registration is not required to place an order. However, it allows you to check the order status and quickly place an order in the future without having to re-enter the data.

6. Logging in to the Account is done by entering the login and password set in the Registration Form.



§5 The rules of placing an order

1. The order constitutes an offer within the meaning of the provisions of the Civil Code. Confirmation of the acceptance of the order is the acceptance of the offer according to the content of the statement submitted by the Store.

2. In order to place an order:

a) log in to the store

b) select the Product that is the subject of the Order, and then click the "Add to basket" button

c) log in or use the option of placing an Order without registration

d) if the option to place an Order without registration has been chosen - fill in the Order Form by entering the details of the order recipient and the address to which the Product delivery is to be made, choose the type of shipment (method of delivery of the Product), enter the invoice data if different from the recipient's details

e) click the "Order and pay" button / click the "Order and pay" button and confirm the order by clicking the link sent in the e-mail

f) choose one of the available payment methods and, depending on the method of payment, pay the order within a specified period

g) Orders can be placed 24 hours a day throughout the year through the form filled in on the Store's website.

2. Orders are processed on business days from 8.00 to 16.00.

3. The prices of goods are expressed in PLN and include VAT.

4. The customer bears the delivery costs depending on the weight and dimensions of the package.

5. The sale document is attached to the parcel.



§ 6 Offered delivery methods and payments

1. The Customer may use the following methods of delivery or collection of the ordered Product:

a. DHL courier service

2. The customer can use the following payment methods:

a. Payment on delivery

b. Payment by transfer to the Seller's account

c. Electronic payments

3. Detailed information on delivery methods and acceptable payment methods can be found on the Store's website.



§ 7 Execution of the sales contract - execution of orders

1. Conclusion of a Sales Agreement between the Customer and the Seller takes place after the Customer has placed an Order using the Order Form in the Store.

2. After placing the Order, the Seller immediately confirms its receipt and at the same time accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for implementation shall take place by sending by the Seller an e-mail address provided at the time of placing the Order e-mail address, which contains at least the Seller's statement of receipt of the Order and its acceptance for implementation and confirmation of the conclusion of the Sales Agreement. Upon receipt of the above e-mail by the Customer, a Sales Agreement is concluded between the Customer and the Seller.

3. If the customer chooses:

a) payment by bank transfer, electronic payment or payment by credit card, the customer is obliged to make a payment otherwise the order will be canceled.

b) payment on delivery, the Customer is obliged to make the payment upon delivery.

4. The product will be sent by the Seller within the time specified in its description (subject to paragraph 5 of this paragraph), in the manner chosen by the Customer when placing the Order.

5. In the case of ordering Products with different delivery times, the delivery date is the longest given date.

6.The beginning of the delivery of the Product to the Customer counts as follows:

a) if the Customer chooses the method of payment by bank transfer or by electronic payment - from the date of crediting the Seller's bank account

b) if the Customer chooses the method of payment on delivery - from the day of concluding the Sale Agreement

7. Product delivery takes place in Poland only

 

§8 The right to withdraw from the contract

1. The Consumer may withdraw from the Sales Agreement within 14 days without giving any reason.

2. The commencement of the period begins with the delivery of the Product to the Consumer or a person other than the carrier designated by him.

3. In the case of an Agreement, which includes many Products, which are delivered separately, in batches or in parts, the term indicated above runs from the delivery of the last item, lot or part.

4. The Consumer may withdraw from the Agreement by submitting to the Seller a statement of withdrawal from the Agreement. To meet the deadline for withdrawal from the Agreement, it is sufficient for the Consumer to send a statement before the expiry of that period.

6. In the event of withdrawal from a distance contract, the contract is considered null and void. What the parties have rendered is returned, unless the change was necessary within the limits of ordinary management. The return should take place immediately, not later than within 14 days. The purchased goods should be returned to the correspondence address of the company: Weyer Polska Sp. z o.o., ul. Zielona 19, 24-100 Puławy.



§ 9 Complaints

1. New products are covered by the sales contract.

2. In the event of a defect of the purchased goods, the customer has the right to complaint.

3. Complaints should be reported in writing to: Weyer Polska Sp. z o.o., ul. Zielona 19, 24-100 Puławy, or electronically to the e-mail address: j.glogowska@weyer-group.com / m.jankowska@weyer-group.com.

4. A sample complaint form can be found here. It is recommended that the complaint contain a brief description of the defect, circumstances (including date) of its occurrence, data of the customer submitting the complaint, and the customer’s request in regard to the defective goods.

5. A member of our customer service team should contact you immediately, or within 14 days. Should this procedure not be followed, it is considered that the customer's request is justified.

6. Goods sent back as part of the complaint procedure should be sent to: Weyer Polska Sp. z o.o., ul. Zielona 19, 24-100 Puławy.

7. If a damaged parcel is received, please write / fill in a damage report with the courier.

 

§10 Final Provisions

1. The Customers' data is stored by the Store in accordance with the provisions of the Act on Personal Data Protection and is used only in connection with the activities of the Store.

2. In matters not covered by these Regulations, the provisions of generally applicable Polish law shall apply, in particular the provisions of the Civil Code, the Act on the Protection of Personal Data, the Act on Electronic Services, and the Act on the Protection of Certain Consumer Rights and Liability for Damage Caused by dangerous products.

3. Any disputes between the parties shall be resolved by a competent common court.
